These GTC apply to consumers and businesses purchasing products through our online store.

A consumer is any natural person acting for purposes that are predominantly outside their trade, business or profession.

A business is any natural or legal person acting in the exercise of their trade, business or profession.

Any conflicting terms of the customer shall not apply unless expressly agreed by us in writing.

2. Contract Formation

The presentation of products in our online store does not constitute a legally binding offer.

By placing an order and clicking the checkout button, you submit a binding offer to purchase the selected products.

The purchase agreement is concluded only when we:

  • send an order confirmation by email; or
  • dispatch the ordered goods.

We reserve the right to reject or cancel orders where legally permitted, including in cases of:

  • pricing or technical errors;
  • inventory inaccuracies;
  • suspected fraud;
  • automated purchases using bots;
  • abuse of promotions;
  • violations of these GTC.

3. Products, Limited Releases and Availability

Certain products are released in limited quantities (“Drops”).

Accordingly:

  • product availability cannot be guaranteed;
  • products may sell out without notice;
  • shopping cart reservation is not guaranteed until checkout is completed.

Orders may be cancelled if products become unavailable due to technical or inventory errors.

4. Prices

Unless stated otherwise, all prices are shown in Euro (EUR).

Prices include applicable VAT where required by law.

Shipping costs, customs duties, import taxes and other charges are displayed separately where applicable before the order is completed.

Customers outside the European Union may be responsible for local customs duties, taxes or import fees.

5. Payment

Available payment methods may include:

  • Visa / Mastercard
  • PayPal
  • Klarna
  • Instant Bank Transfer
  • Apple Pay
  • Google Pay
  • Shop Pay

Not every payment method is available in every country.

We reserve the right to restrict payment methods depending on the order.

6. Shipping and Delivery

Delivery times shown in the online store are estimates only.

Unless otherwise agreed, delivery shall be made to the shipping address provided during checkout.

Risk passes to consumers only upon delivery.

For business customers, the statutory rules apply.

7. Pre-Orders

Products marked as Pre-Order are not immediately available.

Estimated shipping dates are provided on the product page.

Delays may occur due to production, logistics or customs.

If significant delays occur, customers will be informed.

Nothing in this clause limits any mandatory statutory rights of consumers.

8. Retention of Title

The goods remain our property until full payment has been received.

9. Right of Withdrawal

Consumers located within the European Union have the statutory right of withdrawal.

Further details, conditions and withdrawal instructions are provided in our separate Withdrawal Policy.

10. Returns

Returned products must be:

  • unworn;
  • unwashed;
  • free from stains or odors;
  • undamaged;
  • complete with all original tags attached.

Customers may inspect goods only to the extent necessary to establish their nature, characteristics and functioning.

If returned products show signs of use beyond what is legally permitted, compensation for diminished value may be deducted in accordance with applicable consumer protection law.

Nothing in this section limits mandatory statutory consumer rights.

11. Warranty

Customers are entitled to the statutory warranty rights applicable under mandatory law.

12. Liability

We are liable without limitation for:

  • intent;
  • gross negligence;
  • injury to life, body or health;
  • liability under applicable product liability legislation.

For slight negligence, we are liable only for breaches of essential contractual obligations (cardinal obligations).

In such cases liability is limited to the foreseeable damage typical for the contract.

Nothing in these GTC excludes liability where exclusion is prohibited by law.

13. Abuse, Fraud Prevention and Resale

To ensure fair access to limited product releases, we reserve the right to:

  • cancel orders;
  • refuse future orders;
  • limit purchase quantities;
  • suspend customer accounts.

This may occur where there is reasonable suspicion of:

  • automated purchasing (bots);
  • fraudulent activity;
  • payment abuse;
  • large-scale commercial resale;
  • circumvention of purchase limits.

14. Intellectual Property

All trademarks, logos, product designs, photographs, graphics and website content remain the intellectual property of WIDEOPEN – Manuel Prager or the respective rights holders.

No licence or right of use is granted except as required for personal shopping.

15. Privacy

The processing of personal data is governed exclusively by our separate Privacy Policy, which forms part of our website.

16. Online Dispute Resolution

The European Commission formerly provided an Online Dispute Resolution (ODR) platform. Since 20 July 2025, the ODR platform has been discontinued and is no longer available.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

17. Governing Law

These GTC shall be governed by the laws of the Federal Republic of Germany.

If you are a consumer residing in another EU Member State, you also benefit from any mandatory consumer protection provisions of your country of residence.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

For business customers, where legally permissible, the exclusive place of jurisdiction shall be our registered place of business.

18. Severability

If any provision of these GTC is held to be invalid or unenforceable, the remaining provisions shall remain unaffected to the fullest extent permitted by law.
